Chapter 58.--PERSONAL AND REAL PROPERTY
Part 6.--MISCELLANEOUS PROVISIONS
Article 25.--LANDLORDS AND TENANTS

      58-25,103.   Definitions.Subject to additional definitions contained in subsequent sections of this actwhich apply to specific sections thereof, and unless the context otherwiserequires, in this act:

      (a)   "Building and housing codes" includes any law, ordinance orgovernmental rule and regulation concerning fitness for habitation or theconstruction, maintenance, operation, occupancy, use or appearance of anymobile home park, dwelling unit or mobile home space.

      (b)   "Business" includes a corporation, government, governmentalsubdivision or agency, business trust, estate, trust, partnership orassociation, two or more persons having a joint or common interest and anyother legal or commercial entity which is a landlord, owner, manager orconstructive agent pursuant to K.S.A. 58-25,109.

      (c)   "Dwelling unit" excludes real property used to accommodate a mobilehome.

      (d)   "Landlord" means the owner, lessor or sublessor of a mobile homepark and it also means a manager of the mobile home park who fails todisclose as required by K.S.A. 58-25,109.

      (e)   "Mobile home" includes manufactured homes and mobile homes as defined insubsections (a) and (b) of K.S.A. 58-4202, and amendments thereto.

      (f)   "Mobile home park" shall mean any site, lot, field or tract of land uponwhich two or more occupied mobile homes are harbored, either free of charge orfor revenue purposes, and shall include any building, structure, or enclosureused or intended for use as part of the equipment of such mobile home park.

      (g)   "Mobile home space" means a plot of ground within a mobile home parkdesigned for the accommodation of one mobile home.

      (h)   "Owner" means one or more persons, jointly or severally, in whom isvested all or part of the legal title to property or all or part of thebeneficial ownership and a right to present use and enjoyment of the mobilehome park. The term includes a mortgagee in possession.

      (i)   "Rent" means all payments to be made to the landlord under the rentalagreement, other than the security deposit.

      (j)   "Rental agreement" means agreements, written or those implied bylaw, and valid rules and regulations adopted under K.S.A. 58-25,114embodying the terms and conditions concerning the use and occupancy of a mobilehome space.

      (k)   "Security deposit" means a deposit of money to secure performance of amobile home space rental agreement under this act other than a deposit which isexclusively in advance payment of rent.

      (l)   "Tenant" means a person entitled under a rental agreement to occupya mobile home space to the exclusion of others.
