      58-25,118.   Failure to deliver possession; remedies.(a) If the landlord fails to deliver physical possession of the mobile homespace to the tenant as provided in K.S.A. 58-25,110, rent abatesuntil possession is delivered and the tenant:

      (1)   Upon at least five days' written notice to the landlord, may terminatethe rental agreement and upon termination the landlord shall return all of thesecurity deposit; or

      (2)   may demand performance of the rental agreement by the landlord and, ifthe tenant elects, maintain an action for possession of the mobile homespace against the landlord, or any person in wrongful possession, and recoverthe damages sustained by the tenant.

      (b)   If a person's failure to deliver possession is willful and not in goodfaith, an aggrieved party may recover from such person an amount not more than1 1/2 months' periodic rent or 1 1/2 times the actual damages sustained bysuch party, whichever is greater.
