Chapter 58.--PERSONAL AND REAL PROPERTY

Article 31.--APARTMENT OWNERSHIP ACT

      58-3124.   Joint and several liability of grantor and grantee for unpaidcommon expenses.In a voluntary conveyance the grantee of an apartment shall be jointlyand severally liable with the grantor for all unpaid assessments againstthe latter for his or her share of the common expenses up to the time of the grantor conveyance, without prejucice to the grantee's right to recover from thegrantor the amounts paid by the grantee therefor. However, any such granteeshall be entitled to a statement from the manager or board of directors, asthe case may be, setting forth the amount of the unpaid assessments againstthe grantor and such grantee shall not be liable for, nor shall theapartment conveyed be subject to a lien for, any unpaid assessments againstthe grantor in excess of the amount therein set forth.
