Chapter 58.--PERSONAL AND REAL PROPERTY
Part 6.--MISCELLANEOUS PROVISIONS
Article 45.--HOME INSPECTORS

      58-4510.   Exemption from registration.This act shall apply to all individuals who conduct homeinspections forcompensation, but shall not apply to the following individuals who arespecifically exemptedfrom registration under this act:

      (a)   A tradesman or contractor performing a single component or systemevaluation or a combination of any two systems orcomponents listed in K.S.A. 2009 Supp. 58-4502 (a)(1)(A)-(I), and amendmentsthereto, while actingwithin the scope ofthat occupation;

      (b)   an individual employed by the state or a political subdivision of thestate who, within thescope of such employment and in the discharge of such publicduties, inspects propertyor buildings for compliance with requirements safeguarding life, health orproperty;

      (c)   an individual licensed by the state as an architect while acting withinthe scope of that license;

      (d)   an individual licensed by the state as a professional engineer whileacting within the scope ofthat license;

      (e)   an individual licensed by the state as a real estate appraiser whileacting within the scope ofthat license;

      (f)   an individual licensed by the state as a real estate broker orsalesperson while acting withinthe scope of that license;

      (g)   an individual employed as an insurance adjuster while acting within thescope of thatoccupation;

      (h)   an individual licensed as a manufactured home manufacturerwhile acting within the scope of that license;

      (i)   an individual employed by a manufactured home manufacturer while actingwithin the scope of that occupation;

      (j)   a modular home manufacturer or modular home manufacturer's representativereviewing a residential dwelling built by the manufacturer for the purpose ofevaluating the residential dwelling;

      (k)   an individual licensed as a manufactured home dealer while acting withinthe scope of that license;

      (l)   an individual employed as a manufactured home installer while actingwithin the scope ofthat occupation;

      (m)   an individual licensed by the state as an insurance agent while actingwithin the scope of that license;

      (n)   a homebuilder or homebuilder's representative reviewing a residentialdwelling built by thehomebuilder for the purposes of evaluating the residential dwelling;

      (o)   an individual providing services as a pestexterminator or chemical applicator while acting within thescope of that occupation and not providing services which would constitute ahome inspectionunder this act; and

      (p)   A person who is not registered as a home inspector, may assist aregistered home inspector in the performance of an inspectionprovided that the person is supervised at the inspection site by aregistered home inspector and any home inspection report renderedin connection with the home inspection is reviewed and signed by theregistered home inspector.
