Chapter 59.--PROBATE CODE
Article 10.--PARTNERSHIP ESTATES

      59-1002.   When administrator takes charge.In case the surviving partner, having been duly cited for that purpose,shall neglect or refuse to give the bond required by law, the executor oradministrator of the estate of the deceased partner, on giving a bond asprovided by law, shall take the whole of the partnership estate into his or herpossession, and shall be authorized to use the name of the survivor incollecting the debts due to the late firm if necessary, and shall with thepartnership property pay the debts due from the late firm with as muchexpedition as possible, and return or pay to the surviving partner his or herproportion of the net proceeds of the partnership estate.
