Chapter 59.--PROBATE CODE Article 23.--PROCEEDINGS FOR SALE, LEASE AND MORTGAGE OF REALTY

59-2310. Authorization of conveyance or lease of real estate.Upon the filing of a petition by any person claiming to be entitled to aconveyance from a decedent or conservatee bound by written instrument tomake a conveyance or lease, or by the personal representative, setting forth adescription of the real estate and the facts upon which such claim forconveyance or lease is based, the court shall fix the time and place forthe hearing thereof, notice of which shall be given to such persons and insuch manner as the court shall direct. Upon proof of the petition, thecourt may order the personal representative to execute and deliver a deed ofconveyance or lease upon performance of the contract.
