Chapter 59.--PROBATE CODE
Article 23.--PROCEEDINGS FOR SALE, LEASE AND MORTGAGE OF REALTY

      59-2314.   Homestead of incapacitated spouse; execution of mortgageand oil, gas and other mineral leases.When a husband or wife, while occupying a homestead, is adjudged to bean incapacitated person, the conservator of such spouse may be authorized,by the district court having jurisdiction, to join with the competent spousein executing a mortgage upon the homestead, renewing or refinancing anencumbrance thereon which is likely to cause loss, or in executing a leasethereon authorizing the lessee, said lessee's heirs and assigns, to explore andproduce therefrom oil, gas, coal, lead, zinc, or other minerals as hereinprovided.
