Chapter 60.--PROCEDURE, CIVIL
Article 33.--ACTIONS RELATING TO COMMERCIAL ACTIVITY

      60-3339.   Compliance with act shall be considered bytribunal indetermining penalties.If a facility owner or operator has implementedan environmentalmanagementsystem, consistent with the primary characteristics prescribed by subsection(d)(2) ofK.S.A. 60-3334, and amendments thereto, a court oradministrative tribunal which finds a violation of such laws, or extension ofsuch laws, shall give consideration to that fact in determiningwhether to impose administrative or civilpenalties and indetermining the severity of any penalties imposed.
