Chapter 65.--PUBLIC HEALTH
Article 1.--SECRETARY OF HEALTH AND ENVIRONMENT, ACTIVITIES

      65-163a.   Same; cessation of water delivery, when; orderby secretary, judicial review.(a) Any supplier of water may refuse to deliver water through pipes andmains to any premises where a condition exists which might lead to thecontamination of the public water supply system and may continue to refuse thedelivery of water to the premises until the condition is remedied.

      (b)   The secretary may order a supplier of water: (1) To cease the deliveryof water through pipes and mains to a premise or premises where a conditionexists which might lead to the contamination of the public water supplysystem; or (2) to cease an activity which would result in a violation ofthe state primary drinking water standards; or (3) to cease an activitywhich results in a continuing violation of the state primary drinking waterstandards; or (4) to comply with any combination of these orders. The supplierof water shall immediately comply with an order issued by the secretaryunder this section.

      (c)   Orders of the secretary under this section, and hearings thereon,shall be subject to the provisions of the Kansas administrative procedureact. Any action of thesecretary pursuant to this section is subject to review in accordance withthe act for judicial review and civil enforcement of agency actions. Thecourt on review shall hearthe appeal without delay.
