Chapter 65.--PUBLIC HEALTH
Article 1.--SECRETARY OF HEALTH AND ENVIRONMENT, ACTIVITIES

      65-167.   Sewage discharge; penalties for willful or negligent dischargeof sewage without permit or in violation of terms of permit.Upon conviction, the penalty for the willful or negligent discharge ofsewage into or from the sewer system of any municipality, township, county orlegally constituted sewer district by the public authorities having, bylaw, charge thereof or by any person, company, corporation, institution,municipality or federal agency, into any of the waters of the statewithout a permit, as required by this act, or in violation ofany term or condition of a permit issued by the secretary of health andenvironment, or in violation of any requirements made pursuant to K.S.A.65-164, 65-165 or 65-166, and amendments thereto, shall be not lessthan $2,500 and not morethan $25,000, and a further penalty of not morethan $25,000 per day foreach day the offense ismaintained. The penalty for the discharge of sewage into or from any sewage systeminto any waters of the state without filing a report, in any case in whicha report is required by this act to be filed shall be not lessthan $1,000 and not more than $10,000 per day for each day the offense is maintained.
