Chapter 65.--PUBLIC HEALTH
Article 1.--SECRETARY OF HEALTH AND ENVIRONMENT, ACTIVITIES

      65-1,109a.   Certification of laboratories performing environmentalanalyses.(a) The secretary of health and environment may adopt rules andregulations establishing: (1) Procedures and qualifications for certificationof laboratories performing analyses required pursuant to K.S.A. 65-161 etseq., 65-171d, 65-3001 et seq., 65-3401 etseq. or 65-3430 et seq. or K.S.A. 65-3452a et seq.or65-34,105 et seq., and amendments thereto;and (2) a schedule of fees to defray all or part of the costs of administeringthe certification program. Such fees shall not be refundable. Failure to payassessed fees shall be cause for denial of certification.

      (b)   Any person who violates any provision of the rules and regulationsadopted under this act shall, after notice and hearing in accordance with theKansas administrative procedure act, be subject to suspension, denial orrevocation of any certification granted hereunder and a civil penalty not toexceed $500. Each day a violation continues shall be deemed a separateviolation.

      (c)   The secretary of health and environment shall remitall moneys received from fees or penalties pursuant tothis sectionto the state treasurer in accordance with the provisions of K.S.A. 75-4215,andamendments thereto.Upon receipt of each such remittance, the statetreasurer shall deposit the entireamount in the state treasury to the credit of thestate general fund.
