Chapter 65.--PUBLIC HEALTH Article 1.--SECRETARY OF HEALTH AND ENVIRONMENT, ACTIVITIES

65-1,223. Exclusions from act.(a) The provisions of this act, except the provisions ofsubsection(b) ofK.S.A. 2009 Supp.65-2,230, and amendments thereto, shall notapply to solidwastedisposal areas which are issued permits pursuant to K.S.A. 65-3407, andamendments thereto, orwhich receive authorization from the secretary for unpermitted disposalpursuant to K.S.A. 65-3407c, and amendments thereto, provided that the owner ofeach such solid wastedisposal areaestablishes environmental use controls for the area, subject to approval by thedepartment, byexecuting and filing a restrictive covenant on the property deed.

(b) The provisions of this act shall not apply to confined feedingfacilities as defined in K.S.A. 65-171d, and amendments thereto.
