Chapter 65.--PUBLIC HEALTH
Article 1.--SECRETARY OF HEALTH AND ENVIRONMENT, ACTIVITIES

      65-1,243.   Confidentiality of records.(a) Except as provided in this section, records received andinformation assembled by the birth defects information system pursuant toK.S.A. 2009 Supp.65-1,241, and amendments thereto, are confidential medicalrecords.All medical records reviewed and maintained by the department pursuant to thissection shall be kept confidential and shall not be disclosed except upon theorder of a court of competent jurisdiction and shall not be subject tosubpoena, discovery or other demand in any administrative, criminal or civilmatter.

      (b)   The secretary may use information assembled by the system to notifyparents, guardians and custodians of children with congenital anomalies orabnormal conditions of medical care and other services available for the childand family.

      (c)   The secretary may disclose information assembled by the system insummary, statistical or other form that does not identify particularindividuals or individual sources of information.
