Article 14.--REGULATION OF DENTISTS AND DENTAL HYGIENISTS

      65-1431a.   Reinstatement of a revoked license;application form; burden of proof; conditions and restrictions; proceedings;stay of order of revocation of license.(a) A person whose license has been revoked may apply forreinstatement of the license after the expiration of three years from theeffective date of the revocation. Application for reinstatement shall be on aform provided by the board and shall be accompanied by a reinstatement of arevoked license fee established by the board under K.S.A. 65-1447 andamendmentsthereto. The burden of proof by clear and convincing evidence shall be on theapplicant to show sufficient rehabilitation to justify reinstatement of thelicense. The applicant shall comply with all conditions imposed by the board inestablishing justification for rehabilitation. The board may establishconditions or restrictions on the reinstatement of the applicant's license asit deems appropriate. If the board determines a license should not bereinstated, the person shall not be eligible to reapply for reinstatement forthree years from the effective date of the denial. All proceedings conducted onan application for reinstatement shall be in accordance with the provisions ofthe Kansas administrative procedure act and shall be reviewable in accordancewith the act for judicial review and civil enforcement of agency actions. Theboard, on its own motion, may stay the effectiveness of an order of revocationof license.

      (b)   This section shall be part of and supplemental to the dentalpractices act.
