Article 16.--REGULATION OF PHARMACISTS

      65-1658.   Civil fines for violations.The state board of pharmacy, in addition to any otherpenalty prescribed under the pharmacy act of the state of Kansas, may assess acivil fine, after notice and an opportunity to be heard in accordance with theKansas administrative procedure act, against any licensee or registrant undersubsections (a), (c), (d) and (e) of K.S.A. 65-1627, andamendments thereto, forviolation of the pharmacy act of the state of Kansas or rules and regulationsof the state board of pharmacy adopted under the pharmacy act of the state ofKansas or for violation of the uniform controlled substances act or rules andregulations of the state board of pharmacy adopted under the uniform controlledsubstances act, in an amount not to exceed $5,000 for eachviolation.All fines assessed and collected under this section shall be remitted to thestate treasurer in accordance with the provisions of K.S.A. 75-4215, andamendments thereto.Of the amount so remitted, an amount equal to the board's actual costsrelated to the case in which the fine was assessed, as certified by thepresident of the board to the state treasurer, shall be credited to the stateboard of pharmacy fee fund, and the balance shall be credited to the stategeneral fund.
