Chapter 65.--PUBLIC HEALTH
Article 16.--REGULATION OF PHARMACISTS

      65-1693.   Same; penalties.(a) A dispenser who knowingly fails to submit prescriptionmonitoring information to the board as required by this act or knowinglysubmits incorrect prescription monitoring information shall be guilty of aseverity level 10, nonperson felony.

      (b)   A person authorized to have prescription monitoring information pursuantto this act who knowingly discloses such information in violation of this actshall be guilty of a severity level 10, nonperson felony.

      (c)   A person authorized to have prescription monitoring information pursuantto this act who knowingly uses such information in a manner or for a purpose inviolationof this act shall be guilty of a severity level 10, nonperson felony.

      (d)   It shall not be a violation of this act for a practitioner or dispenserto disclose or useinformation obtained pursuant to this act when such information is disclosed orused solely in thecourse of such practitioner's or dispenser's care of the patient who is thesubject of theinformation.
