Chapter 65.--PUBLIC HEALTH
Article 16.--REGULATION OF PHARMACISTS

      65-16,101.   Statewide electronic logging system forsale of methamphetamine precursor act; definitions.As used in the statewide electronic logging system forsale of methamphetamine precursor act, unless the context otherwiserequires:

      (a)   "Board" means the state board of pharmacy.

      (b)   "Methamphetamine precursor" means any compound, mixtureor preparation containing pseudoephedrine, ephedrine orphenylpropanolamine, or any of their salts or optical isomers, orsalts of optical isomers, but does not include products that havebeen formulated in such a way as to effectively prevent theconversion of the active ingredient into methamphetamine, or its salts forprecursors, and does not include animal feed products containing ephedrine orany naturally occurring or herbal ephedraor extract of ephedra.

      (c)   "Pharmacy" means premises, laboratory, area or otherplace, including in-state and out-of-statefacilitiesthat are required to be registered under K.S.A. 65-1643 or 65-1657, andamendments thereto: (1) Where drugs are offered for sale where the professionofpharmacy is practiced and where prescriptions are compoundedand dispensed; or (2) which has displayed upon it or within itthe words "pharmacist," "pharmaceutical chemist," "pharmacy,""apothecary," "drugstore," "druggist," "drugs," "drug sundries"or any of these words or combinations of these words or words ofsimilar import either in English or any sign containing any ofthese words; or (3) where the characteristic symbols of pharmacyor the characteristic prescription sign "Rx" may be exhibited.
