Article 19.--LICENSURE OF ENTITIES BY STATE BOARD OF COSMETOLOGY

      65-1904a.   Salon or clinic license; applicationand fee; inspection and reinspection;practice in private residence; renewal; practice outside salon, clinic orprivate residence.(a) Any licensed cosmetologist, esthetician, electrologist, manicurist,orpersondesiring to establish a salon or clinicshall make application, on a form provided, to the Kansas state board ofcosmetology, accompanied by the new salon or cliniclicense fee establishedunder K.S.A. 65-1904, and amendments thereto. Upon filing of theapplication,the board shall inspect the equipment as to safety and sanitarycondition of the premises and if the equipment and premises are foundto comply with the rules and regulations of the secretary of health andenvironment and the rules and regulations of theKansas state board ofcosmetology, the board shall issue a new salon orclinic license.

      (b)   Nothingherein contained shall be construed as preventing any licensedcosmetologist, manicurist, esthetician or electrologist from practicing inthe field for which licensed in such licensee's private home orresidence if the homeor residence complies with rules and regulations of thesecretary and the state board.A licensed cosmetologist, manicurist, esthetician or electrologist mayprovide services in the field in which licensed in aplace other than the licensed salon or clinicor a private home or residence of the licensed cosmetologist, manicurist,esthetician or electrologist.Excludingservices provided by a licensed cosmetologist, manicurist, esthetician orelectrologist in a health care facility,hospital or nursing home or in the residence of a person requiring home carearising from physical or mental disabilities, in order toprovide such services, such licensedcosmetologist, manicurist, esthetician or electrologist shall beemployed in a salon or clinic or in the licensedcosmetologist's, manicurist's, esthetician's or electrologist's privatehome or residence for at least 51% of the total hoursperweek employed; and shall attest by affidavitthat such cosmetology, manicuring, esthetics or electrology servicesshall beprovided only in the residence or office of the person receivingservices.

      (c)   Licensed salons and clinics may be reinspected in accordance witha scheduledetermined by the board by rules and regulations or upon a complaint made tothe board that such salon or clinic is not being maintained in compliance withrules and regulations of the board.Thelicense shall expire on June 30 following its issuance. Any suchlicense may be renewed upon application accompanied by thesalon or cliniclicense renewal fee made to the board before July 1 of the year inwhich the license expires. Any license may be renewed bytheapplicant within 60 days after the date of expiration of thelast license upon payment of a delinquent renewal fee.
