Article 19.--LICENSURE OF ENTITIES BY STATE BOARD OF COSMETOLOGY

      65-1912.   Apprentice license; practice as apprenticerequired prior tolicensure; chargefor services of apprentice.(a) Any person desiring to practice as an apprentice shallbe required to pay to the board the fee required pursuant to K.S.A.65-1904,and amendments thereto, and obtain an apprentice license from the board.Application for an apprentice license allowing a person to practice in alicensed school shall be submitted to the board not more than 15 days afterthe person's enrollment in the school.

      (b) (1)   An applicant for examination and licensure as a cosmetologistshall be required to have practiced as an apprentice in a licensed schoolfor not less than 1,500 clock hours or, if the applicant has attended alicensed school electing to base the course of instruction and practice oncredit hours as provided in K.S.A. 65-1903, and amendments thereto, theapplicant shall have practiced as an apprentice for not less than those credithours which are the equivalent of 1,500 clock hours under the formula forconversion used by the licensed school.

      (2) (A)   Before July 1,2009,an applicant for examination and licensure as an estheticianshall be required to have practiced as an apprentice in a licensed schoolfor not less than 650 clock hours or, if the applicant hasattended alicensed school electing to base the course of instruction and practice oncredit hours as provided in K.S.A. 65-1903, and amendments thereto, theapplicant shall have practiced as an apprentice for not less than those credithours which are the equivalent of 650 clock hours under theformula forconversion used by the licensed school.

      (B)   On and after July 1, 2009, an applicant for examination andlicensure as an esthetician shall be required to have practiced as anapprentice in a licensed school for not less than 1,000 clock hours,or, if the applicant has attended a licensed school electing to basethe course of instruction and practice on credit hours as provided inK.S.A. 65-1903, and amendments thereto, the applicant shall havepracticed as an apprentice for not less than those credit hours whichare the equivalent of 1,000 clock hours under the formula forconversion used by the licensed school.

      (3)   An applicant for examination and licensure as a manicurist shall berequired to have practiced as an apprentice in a licensed school ofcosmetology or nail technology for notless than 350 clock hours or, if the applicant has attended a licensedschool electing to base the course of instruction and practice on credit hoursas provided in K.S.A. 65-1903, and amendments thereto, the applicant shall havepracticed as an apprentice for not less than those credit hours which are theequivalent of 350 clock hours under the formula for conversion used by thelicensed school.

      (4)   An applicant for examination and licensure as an electrologistshall be required to have practiced as an apprentice: (A) In a licensedschoolof cosmetology or electrology for not less than 500 clock hours or, if theapplicant has attended a licensed school electing to base the course ofinstruction and practice on credit hours as provided in K.S.A. 65-1903, andamendments thereto, the applicant shall have practiced as an apprentice for notless than those credit hours which are the equivalent of 500 clock hours underthe formula for conversion used by the licensed school; or (B) in alicensed clinic or establishment for not less than 1,000 clockhours of training.The duration of practice as an apprentice in a clinic orestablishment must be inthe clinic or establishment in whichpractice was commenced, except that the board may permit, upon writtenapplication and for good cause, the transfer of the apprentice to anotherclinic or establishment for completion of the term ofapprenticeship. Any licensedcosmetologist who is practicing electrology in a licensed clinic orestablishment on July 1, 1987, may apply for and be issued anelectrologist'slicense without examination.

      (c)   No apprentice shall make any charge for the apprentice's services,but a licensed school of cosmetology, electrology or nailtechnology or a proprietorof a licensed clinic or establishment in which anapprentice of electrology practices may charge for services of theapprentice.

      (d)   For purposes of subsection (b), a person is not required to havepracticed as an apprentice continuously or without interruption in obtainingthe required number of hours.
