Chapter 65.--PUBLIC HEALTH
Article 28.--HEALING ARTS

      65-28,105.   Same; written certification and confirmation ofdeclarant's terminal condition; effect of failure to comply.An attending physician who has been notified of the existence of adeclaration executed under this act, without delay after the diagnosisof a terminal condition of the declarant, shall take the necessary stepsto provide for written certification and confirmation of the declarant'sterminal condition, so that declarant may be deemed to be a qualifiedpatient under this act.

      An attending physician who fails to comply with this section shall bedeemed to have refused to comply with the declaration and shall besubject to subsection (a) of K.S.A. 65-28,107.
