Article 29.--PHYSICAL THERAPY

      65-2910.   Renewal of license or certification;renewal requirements;expiration notice; fees; cancellation; reinstatement; inactivelicense.(a) The license of everylicensed physical therapist andthe certification of every certified physical therapist assistant shallexpire on the date established by rules and regulations of theboard which may provide renewal throughout the year on a continuingbasis. In each case in which a license orcertificate is renewed for aperiod of time of less than one year, the board may prorate the amount of thefee established under K.S.A. 65-2911 and amendments thereto. The request forrenewal shall be on a form provided by the board and shall be accompanied bythe renewal fee established under K.S.A. 65-2911 and amendmentstheretowhich shall be paid not later than the expiration date of thelicense orcertificate.

      (b)   The board shall require everylicensed physical therapist or certified physicaltherapist assistant asa condition of renewal to submit with theapplication for a renewal evidence ofsatisfactory completion of a program of continuingeducation required by the board. The board shall establish the requirements foreach such program ofcontinuing education by rules and regulations. In establishing suchrequirements the board shall consider any existing programs of continuingeducation currently being offered to licensed physicaltherapists or certified physical therapist assistants.

      (c)   At least 30 days before the expiration of thelicense of aphysical therapist or the certificate of a physical therapist assistant, theboard shall notify thelicensee or certificate holder ofthe expiration by mail addressed to the licensee'slast mailing address asnoted upon the office records. If the licensee orcertificate holder failsto pay the renewal fee by the date of expiration, thelicensee or certificateholder shall be given a second notice that thelicense or certificatehas expired and the license or certificate may berenewed only if the renewal fee and the late renewal fee are received by theboard within the thirty-day period following the date of expiration and that,if both fees are notreceived within the thirty-day period, the licenseor certificate shall becanceled for failure to renew and shallbe reissued only afterthe physical therapist or physical therapist assistant has been reinstatedunder subsection (d).

      (d)   Any licensee or certificateholder who allows the license orcertificate to be canceled by failing to renew may bereinstated upon recommendation of the board, upon payment of the reinstatementfee and upon submitting evidence of satisfactory completion of anyapplicable reeducation and continuing education requirements established by theboard. The board shall adopt rules and regulations establishing appropriatereeducation and continuing education requirements for reinstatement of personswhose licenses or certificates havebeen canceled for failure to renew.

      (e)   There is hereby created the designation of inactive license. The boardis authorized to issue an inactive license to any physical therapist who makeswritten application for a license as a physical therapist on a form provided bythe board and remits the fee established pursuant to K.S.A. 65-2911,and amendments thereto. The board may issue an inactive license only to aperson who meets all the requirements for a license to practice as a physicaltherapist and who does not actively practice as a physical therapist in thisstate. An inactive license shall not entitle the holder to render professionalservices as a physical therapist. The provisions of subsections (c) and (d)relating to expiration, renewal and reinstatement of a license shall beapplicable to an inactive license issued under this subsection. Each inactivelicensee may apply to engage in active practice by providing to the board proofthat a policy of professional liability insurance will be maintained incompliance withK.S.A. 2009 Supp.65-2920, and amendments thereto, and rulesand regulations adopted by the board.
