Article 30.--AIR QUALITY CONTROL

      65-3022.   Same; determining and monitoring of power generationfacilities environmental impact;programs for; fees; rules and regulations.In order to defray costs in determining and monitoring the environmentalimpact of power generation facilities with respect to air quality and, inthe case of nuclear powered generation facilities, the overall radiologicalimpact thereof, the secretary is authorized and directed to adopt rulesand regulations to provide for the establishment of fees and for the collectionthereof from each such facility. Such fees shall be determined and collectedannually, and such determination shall be based upon the size and type ofsuch facilities. In establishing programs for determining and monitoringenvironmental impact, the secretary shall take into consideration monitoringprograms conducted by other persons and where possible avoid duplicationof effort and expense. The secretary may also provide for quality reviewand evaluation of monitoring conducted by other persons in order to furtherthe objectives of this act and to determine the extent and necessity ofmonitoring programs to be conducted by the department of health and environment.
