Chapter 65.--PUBLIC HEALTH
Article 30.--AIR QUALITY CONTROL

      65-3026.   Criminal penalties.(a) Violation of any provision of subsections (a) through (f)of K.S.A. 65-3025, and amendments thereto, is a class Anonperson misdemeanor.

      (b)   Knowingly violating any provision of K.S.A. 65-3025 is aseverity level 10, nonperson felony.

      (c)   In the case of a continuing violation, every day such violationcontinues shall be deemed a separate violation.

      (d)   The county or district attorney of every county shall file appropriateactions for enforcement of this section upon request of the secretary or uponthe county or district attorney's own motion after consultation with thesecretary.
