Chapter 65.--PUBLIC HEALTH
Article 32.--REVISED UNIFORM ANATOMICAL GIFT ACT

      65-3229.   Manner of making, amending, or revokinganatomical gift of decedent's body or part.(a) A person authorized to make an anatomical giftunderK.S.A. 2009 Supp.65-3228, and amendments thereto, may make ananatomical gift by a document of gift signed by the person making the gift orby that person'soral communication that is electronically recorded or is contemporaneouslyreduced to a recordand signed by the individual receiving the oral communication.

      (b)   Subject to subsection (c), an anatomical gift by a person authorizedunderK.S.A. 2009 Supp.65-3228, and amendments thereto, may be amended orrevoked orally or ina record by any member of a priorclass who isreasonably available. If more than one member of the prior class is reasonablyavailable, the giftmade by a person authorized underK.S.A. 2009 Supp.65-3228, and amendmentsthereto, may be:

      (1)   Amended only if amajority of the reasonably available members agree to theamending of the gift; or

      (2)   revoked only if amajority of the reasonably available members agree to therevoking of the gift or if they are equally divided as to whether to revoke thegift.

      (c)   A revocation under subsection (b) is effectiveonly if, before an incision hasbeen made to remove a part from the donor's body orbefore invasive procedures have begun toprepare the recipient, the procurement organization, transplant hospital, orphysician ortechnician knows of the revocation.
