Article 34.--SOLID AND HAZARDOUS WASTE

      65-3415e.   Fees on disposal at private disposal areas.(a)   Except as provided by subsection (b), any county or group of countiesoperating a solid waste disposal area shall levy a charge on any solid waste,whether generated within or outside such county or counties, that is depositedat any privately owned solid waste disposal area located in such countyor counties. The revenue from such charge may be used by the county or groupof counties forthe development and implementation of its solid waste management plan and thecosts of closure and postclosure cleanup of solid waste disposal areas withinthe county or group of counties.

      (b)   The board of county commissioners of any county by unanimousvote maydetermine not to impose the fee provided forby subsection (a).

      (c)   Any charges imposed by counties under this section shall bein additionto any other fees, charges, franchise payments or taxes imposed for solid wastedeposited at a solid waste disposal area. The secretary of health andenvironmentshall make available to counties information as to the amounts paid by theoperators of solid waste disposal areas under the provisions of K.S.A.65-3415b and amendments thereto.
