Article 34.--SOLID AND HAZARDOUS WASTE

      65-3443.   Prevention or removal of hazard orpollution.(a) If the secretary finds that the generation, accumulation, managementor disposal of a hazardous waste by any person is causing or threatensto causepollution of the land, air or waters of the state or is or threatens tobecome a hazard to persons, propertyor public health or safety or that the provisions of this act or any ruleand regulation adopted pursuant thereto have been otherwise violated, thesecretary may order the person to modifythe generation, accumulation, management or disposal of thehazardous waste or toprovide and implement such hazardous waste managementprocedures as will preventor remove the pollution or hazard or take any other action deemednecessary. The secretary may order any person havinga permit issued under this act, and who operates a public or commercialhazardous waste management facility,which the secretaryfinds suitable to manage the hazardous waste, to provide and implementhazardous waste management procedures to prevent or remove suchpollution or hazard. Such order shall specify a fair compensation to theowner or permittee for property taken or used and shall specify the termsand conditions under which the permittee shall provide the hazardous wastemanagement services. Any order issued shall specify the length of timeafter receipt of the order during which the person or permittee shall provideor implement hazardous waste management proceduresor modify the generation,accumulation or management of the hazardous waste.

      (b)   The secretary shall adopt rules and regulations providing for approvalof closure and postclosure plans, establishing standards for undergroundinjection, land treatment, mound landfill and aboveground storage of hazardous waste.

      (c)   Any order of thesecretary pursuant to subsection (a) is subject tohearing and review in accordancewith K.S.A. 65-3440 andamendments thereto.
