Chapter 65.--PUBLIC HEALTH
Article 34.--SOLID AND HAZARDOUS WASTE

      65-3485.   Same; reasons for approval or denial of application required; appeals.(a) The secretary either shall issue the permit or deny the application. Alocal ordinance, permit requirement or other requirement shall not prohibitthe construction or modification of such a PCB disposal facility orrestrict transportationto the facility.

      (b)   If the secretary denies the application, thesecretary shall state thespecific reason or reasons for denialin writing.

      (c)   Any person aggrieved by a final decision of the secretarymay make anappeal to the district court within 30 days of notice of that decision.
