Article 34.--SOLID AND HAZARDOUS WASTE

      65-34,131.   Kansas essential fuels supply trust fund;reimbursement for allowable expenses.(a) There is hereby established as a segregated fund inthe state treasury the Kansas essential fuels supply trust fund. The fuelssupply fund shall be administered by the secretary. Revenue from the followingsources shall be deposited in the state treasury and credited to the fuelssupply fund:

      (1)   The applicable proceeds of the environmental assurance fee imposed byK.S.A. 65-34,117, and amendments thereto; and

      (2)   interest attributable to investment of moneys in the fuels supply fund.

      (b)   The fuels supply fund shall be used for the following:

      (1)   To reimburse an eligible owner of anaboveground storage tank or bulk plant in accordance with the provisions ofK.S.A. 2009 Supp.65-34,132, and amendments thereto, for allowable expenses foran upgrade orpermanent closure of an aboveground storage tank or bulk plant; and

      (2)   payment of the administrative technical and legal costs incurred by thesecretary in carrying out the provisions ofK.S.A. 2009 Supp.65-34,131 and65-34,132, and amendmentsthereto, including the cost of any additional employees or increased generaloperating costs of the department attributable thereto, which costs shall notbe payablefrom any moneys other than those credited to the fuels supply trust fund.

      (c)   On or before the 10th of each month, the director of accounts and reportsshall transfer from the state general fund to the above Kansas essential fuelssupply trust fund interestearnings based on:

      (1)   The average daily balance of moneys in the above Kansas essential fuelssupply trust fund for thepreceding month; and

      (2)   the net earnings rate of the pooled money investment portfolio for thepreceding month.

      (d)   All expenditures from the above Kansas essential fuels supply trust fundshall be made in accordancewith appropriation acts upon warrants of the director of accounts and reportsissued pursuant to vouchers approved by the secretary for the purposes setforth in this section.

      (e)   This section shall be part of and supplemental to the Kansas storage tankact.
