Article 40.--ALCOHOLISM AND INTOXICATION TREATMENT

      65-4013.   Application for license; rules andregulations;fees.(a) An application for a license to establish, conduct, manage or operate atreatment facility shall be made to the secretary uponforms provided by the secretary and shall contain such information asthe secretary may require, which may include affirmativeevidence of ability to comply with such reasonable standards and rulesand regulations as are lawfully adopted pursuant to thisact. Allapplications must be accompanied by an application fee not toexceed $100 asfixed by thesecretary by rules and regulations. Theapplication fee in effect under this section on the day precedingthe effective date of this act shall continue in effect until the secretaryfixes a different application fee by rules and regulations.

      (b)   The secretaryof health and environment may adoptrules and regulations with regard to the health standards which must bemaintained by treatment facilities and may enforce such rules andregulations in accordance with the authority granted the secretary ofhealth and environment under K.S.A. 65-425 et seq. and amendmentsthereto. If the rules and regulations of the secretary of health andenvironment establish such standards, an application under this sectionshall be accompanied by certification from the secretary of health andenvironment that the applicant has met the requirements established bysuch rules and regulations.
