Chapter 65.--PUBLIC HEALTH
Article 40.--ALCOHOLISM AND INTOXICATION TREATMENT

      65-4059.   Cities and counties prohibited from adopting certain enactmentsrelating to intoxicated persons; exceptions.No county or city shall adopt any local law, ordinance, resolution or regulationhaving the force of law rendering public intoxication by alcohol in andof itself or being a common drunkard or being found in enumerated placesin an intoxicated condition, an offense, a violation, or the subject ofcriminal penalties. Nothing herein contained shall affect any laws, ordinances,resolutions or regulations against drunken driving, driving under the influenceof alcohol, or other similar offenses that involve the operation of motorvehicles, machinery or other hazardous equipment.
