Article 41.--CONTROLLED SUBSTANCES

      65-4119.   Denial, suspension, revocation or refusal to renewregistration; order to show cause.(a) Before denying, suspending or revoking a registration or refusing arenewal of registration, the board shall serve upon the applicant orregistrant an order to show cause why registration should not be denied,revoked or suspended or why the renewal should not be refused. In the caseof a denial or renewal of registration theshow cause order shall be served not later than 15 days beforethe expiration of the registration. Proceedings on a show causeorder shall be conductedin accordance with the provisions of theKansas administrative procedure act without regardto any criminal prosecution or other proceeding.

      (b)   In accordance with the provisions of K.S.A. 77-536 andamendments thereto, the board may suspend, without an order to show cause, anyregistration simultaneously with the institution of proceedings underK.S.A. 65-4118 and amendments thereto, or where renewal of registrationis refused, if itfinds that there is an imminent danger to the public health or safetywhich warrants this action. The suspension shall continue in effectuntil the conclusion of the proceedings, including judicial reviewthereof, unless sooner withdrawn by the board or dissolved by a court ofcompetent jurisdiction.
