Chapter 65.--PUBLIC HEALTH
Article 5.--MATERNITY CENTERS AND CHILD CARE FACILITIES

      65-517.   Family day care home defined.(a) "Family day care home" means a place maintainedfor the purpose of providing children with food or lodging, or both, awayfrom such children's home or homes, for less than 24 hoursa day, if:

      (1)   Not more than six of the children cared for at such placeare lessthan 16 years of age; and

      (2)   not more than three of the children cared for at such place areless than 18 months of age.

      (b)   Any child of a person maintaining a place referred toin subsection(a) shall count toward the limitations of subsection (a) if such child is lessthan 12 years of age and is cared for at such place.

      (c)   A person shall not be considered to be maintaining a family day carehome as defined in subsection (a), if only children who are related by blood,marriage or legal adoption to such person are cared for.
