Chapter 65.--PUBLIC HEALTH
Article 5.--MATERNITY CENTERS AND CHILD CARE FACILITIES

      65-519.   Certificate of registration; conditions; application for;immunizations; renewal; fees.(a) The secretary shall issue a certificate of registrationto any person who: (1) Applies for registration on forms furnished by thesecretary; (2) attests to the safety of the family day care home for the careofchildren; (3) submits a fee of not to exceed $15 asestablished by rules and regulations of the secretary of health andenvironment payable to thesecretary ofhealth and environment; and (4) certifies that no person described insubsection (a)(1), (2), (3),(4), (5) or (6) of K.S.A. 65-516, and amendments thereto,resides, works or volunteers in the family day care home.The fee in effect under this subsection (a) immediately prior to theeffective date of this act shall continue in effect on and after the effectivedate of this act until a different fee is established by the secretary ofhealthand environment by rules and regulations under this subsection.

      (b)   The secretary shall furnisheach applicant for registration a family day care home safety evaluationform to be completed by the applicant and submitted with the registrationapplication.

      (c) (1)   Each child cared for in a familydaycare home, including children of the person maintaining the home, shall berequired to have current such immunizations as the secretary of health andenvironment considers necessary. The person maintaining a family day care homeshall maintain a record of each child's immunizations, and shall provide to thesecretary of health and environment such information relating thereto, inaccordance with rules and regulations of the secretary, but the personmaintaining a family day care home shall not have such person's certificate ofregistration revoked solely for the failure to have or to maintain theimmunization records required by this subsection.

      (2)   The immunization requirement of subsection (c)(1) shall not apply ifone of the following is obtained:

      (A)   Certification from a licensed physician stating that the physicalcondition of the child is such that immunization would endanger the child'slife or health; or

      (B)   a written statement signed by a parent or guardian that the parent orguardian is an adherent of a religious denomination whose teachings are opposedto immunizations.

      (d)   The secretary of health and environment shall provide to each personmaintaining a registered family day care home a list of the requirements forregistration of family day care homes.The person maintaining a family day care home shall provide a copy of such listto the parent or guardian of each child cared for in such home and shallmaintain on the premises a copy of the list which has been signed and dated bythe parent or guardian.

      (e)   The certificate of registration shallbe renewed annually in the same manner provided for in this section.

      (f)   The secretary of health and environment shall remit allmoneysreceived by the secretary from fees under the provisions of this act to thestate treasurer in accordance with the provisions ofK.S.A. 75-4215, and amendments thereto. Upon receipt of eachsuchremittance, thestate treasurer shall deposit the entire amount in the statetreasury to the credit of the stategeneral fund.
