Article 53.--ASBESTOS CONTROL

      65-5308.   Certification of individuals required;exemptions; qualifications;application; fee; renewal.(a) Except as otherwise provided in this act, no individualperson shall engage in anasbestos project unless the person holds a certificate issued by thesecretary for that purpose.

      (b)   The provisions of this act do not apply to an individual person whois an employee of a business entity which is exempted from the provisionsof this act by subsection (b) of K.S.A. 65-5302, and amendments thereto.

      (c)   In order to qualify for a certificate, an individual person musthave successfully completed a basic course, approved by the secretary, onthe health and safety aspects of the removal and encapsulation of asbestosincluding the federal and state standards applicable to asbestos projects.

      (d)   In order to qualify for renewal of a certificate, an individualperson must have successfully completed a review courseapproved and within the period prescribed bythe secretary.

      (e)   Applications for certificates and renewals shall be submitted to thesecretary on forms prescribed by the secretary and shall be accompanied bya fee prescribed by the secretary.

      (f)   A certificate shall expire one year from its effectivedate unless the secretaryestablishes an alternative date by rules and regulations.
