Chapter 65.--PUBLIC HEALTH
Article 55.--RESPIRATORY THERAPY

      65-5506.   Application for licensure;requirements; rules and regulations criteria for educational programs.(a) An applicant applying for licensure as arespiratory therapistshall file a written application on forms provided by the board, showing tothe satisfaction of the board that the applicant meets the followingrequirements:

      (1)   Education: The applicant shall present evidencesatisfactory to the board of having successfully completed an educationalprogram in respiratory therapyapproved by the board.

      (2)   Examination: The applicant shall pass an examination asprovided for in K.S.A. 65-5507 and amendments thereto.

      (3)   Fees: The applicants shall pay to the board allapplicable fees established under K.S.A. 65-5509and amendments thereto.

      (b)   The board shall adopt rules and regulations establishing thecriteria for an educational program in respiratory therapyto obtain successful recognition by the board underparagraph (1) of subsection(a). The board may send a questionnaire developed by the board to anyschool or other entity conducting an educational program in respiratorytherapy for which the board does not have sufficient information todetermine whether the program should be recognized by the board and whetherthe program meets the rules and regulations adopted under this section. The questionnaire providing the necessary information shall be completedand returned to the board in order for the program to be considered forrecognition. The board may contract with investigative agencies,commissions or consultants to assist the board in obtaining informationabout an educational program in respiratory therapy. In entering suchcontracts the authority to recognize an educational program in respiratorytherapy shall remain solely with the board.
