Article 6.--FOOD, DRUGS AND COSMETICS

      65-690.   Same; temporary suspension oflicense.(a) If the secretary of agriculture finds thatthe public health or safety is endangered by the continuedoperation of a food processing plant or retail food store, thesecretary may suspend, temporarily, the license of suchestablishment without notice or hearing in accordance with theemergency adjudication procedures of the provisions of the Kansasadministrative procedure act.

      (b)   In no case shall a temporary suspension of a licenseunder this section be in effect for a period of time in excess of90 days. At the end of such period of time, the licensee shall bereinstated to full licensure unless the secretary has suspendedor revoked the license, after notice and hearing, or the licensehas expired as otherwise provided under the Kansas food, drug andcosmetic act, and amendments thereto, or any rules and regulations ororders issued thereunder.
