Article 62.--MISCELLANEOUS PROVISIONS

      65-6202.   Hospice certified to participate in medicare program may holditself out to public as hospice or licensed hospice; prohibitions;enforcement.(a) Each hospice located in this state which is certifiedto participatein the medicare program under 42 code of federal regulations, chapter IV,section 418.1 et seq. and amendments thereto shall be known and may holditself out to the public as ahospice or as a licensed hospice so long as such hospice is certified toparticipate in the medicare program.

      (b)   Prior to January 1, 1996, an agency, organization or other entity whichis engaged primarily in providing hospice services but which is not certifiedto participate in the medicare program under 42 code of federal regulations,chapter IV, section 418.1 et seq. and amendments thereto may hold itselfout to the public as a hospice.

      (c)   On and after January 1, 1996, no agency, organization or other entityother than a hospice certifiedto participate in the medicare programunder 42 code of federal regulations, chapter IV, section 418.1 et seq. andamendments theretoshall hold itself out to the public as ahospice or as a licensed hospice.

      (d)   The secretary of health and environment may file for an injunctionagainst any agency, organization or other entity or person to restrain orprevent any violations of the provisions ofthis section.
