Article 62.--MISCELLANEOUS PROVISIONS

      65-6215.   Same; notice of assessment; method ofpayment; assessment adjustment when a health maintenance organization ceasesoperations.(a) After December 31 of each year, except as otherwise providedin this subsection, andon or before March 31 of the succeeding year, the department shall send anotice of assessmentto every health maintenance organization subject toassessment under this act.

      (b)   The health maintenance organization notice of assessment shall notify thehealth maintenance organization of its assessment for the state fiscal yearcommencing on the next July 1.

      (c)   Ifa health maintenance organization operates, conducts ormaintains more than one health maintenance organizationin the state, the health maintenance organization shallpay theassessment for each health maintenance organizationseparately.

      (d)   Notwithstanding any other provision in this act, in the case of a personwho ceases to operate, conduct or maintain a health maintenance organization inrespect of which theperson is subject to assessment inK.S.A. 2009 Supp.65-6213, and amendmentsthereto, as ahealth maintenance organization, the assessment for the state fiscal year inwhich the cessation occurs shall be adjusted by multiplying the assessmentcomputed underK.S.A. 2009 Supp.65-6213, and amendments thereto, by afraction, the numeratorof which is the number of days during the year during which the healthmaintenance organization operates, conducts or maintains a health maintenanceorganization and thedenominator of which is 365. Immediately upon ceasing to operate, conduct ormaintain a health maintenance organization, the person shall pay the adjustedassessment for the statefiscal year, to the extent not previously paid.

      (e)   Notwithstanding any other provision in this act, a person who commencesoperating,conducting or maintaining a health maintenance organization shallpay the assessment computed underK.S.A. 2009 Supp.65-6213, and amendments thereto, in installments on the duedates stated inthe notice and onthe regular installment due dates for the state fiscal year occurring after theduedates of the initialnotice.
