Chapter 65.--PUBLIC HEALTH
Article 6a.--MEAT AND POULTRY

      65-6a34a.   Denial or suspension of registration; hearing; appeal.(a) The secretary may deny, suspend, revoke or modify theprovisions of any registration issued under the Kansas meat and poultryinspection act, if the secretary finds, after notice and hearing, that theapplicant or registrant has:

      (1)   Been convicted of or pleaded guilty to a violation of the Kansas meatand poultry inspection act or any rule and regulation promulgatedthereunder;

      (2)   failed to comply with any provision or requirement of the Kansas meatandpoultry inspection act or any rule and regulation adopted thereunder;

      (3)   interfered with or prevented the secretary or any authorized inspectoror any other authorized representative of the secretary from the performance ofthat person's job duties regarding any inspection or the administration of theprovisions of the Kansas meat and poultry inspection act; or

      (4)   denied the secretary or any authorized representative of the secretaryaccess to any premises required to be inspected under the provisions of theKansas meat and poultry inspection act.

      (b)   Before any registration shall be suspended, modified, revoked or deniedrenewal, the secretary shall inform the registrant of the date and place ofhearing upon such proposed revocation, denial or suspension. The hearing shallbe conducted in accordance with the provisions of the Kansas administrativeprocedure act.

      (c)   The registration holder may appeal from the decision and order, inaccordance with the provisions of the act for judicial review and civilenforcement of agency actions.

      (d)   This section shall be part of and supplemental to the Kansas meat andpoultry inspection act, article 6a of chapter 65 of the Kansas StatutesAnnotated, andamendments thereto.
