Chapter 66.--PUBLIC UTILITIES
Article 1.--POWERS OF STATE CORPORATION COMMISSION

      66-128o.   Same; review of plan, when; changes.(a) If the commission approves a decommissioning financingplan under K.S.A. 66-128n and amendments thereto, it shall, at leastevery five years untilthe facility's closing and at least annually after the closing, review thefinancing plan to assess its adequacy. If changed circumstances make a morefrequent review desirable or if the licensee requests it, the commissionmay review the plan after a shorter time interval. The review shallinclude, but not be limited to, the following considerations: (1) Theestimated date of closing the nuclear power generating facility; (2) theestimated cost of decommissioning; (3) the reasonableness of the methodselected for cost estimate purposes; and (4) the adequacy of plans forfinancing the decommissioning and any shortfall resulting from a premature closing.

      (b)   The commission, after conducting a review under subsection (a),may, after a hearing in accordance withthe provisions of the Kansas administrative procedure act, order such changes in thedecommissioning financing plan as it deems necessary to make the plancomply with the provisions of subsection (b) of K.S.A. 66-128n and amendments thereto.
