Chapter 66.--PUBLIC UTILITIES
Article 1.--POWERS OF STATE CORPORATION COMMISSION

      66-1,115a.   Granting of certain permits and certificates withoutformal hearing, when; notice.Notwithstanding the provisions of K.S.A. 66-1,114, andamendments thereto, the commission may issue or grant public motorcarrier certificates or abandonments thereofwithout a formal hearingwhen the request for such issuance, grant or abandonment is made byverified application, and propernotice has been given in accordance with K.S.A. 66-1,114, and amendmentsthereto, if noprotests are lodged against thegranting of the applicationand ifthe applicant demonstrates the applicant is fit,willingand abletoperform such serviceand is in compliance with the commission's safety rules and regulations.Forapplications of public motor carriers transporting household goods orpassengers, if the commission finds that evidenceshows that the proposed service is inconsistent with the public convenienceand necessity, the commission shall not grant the application.
