Chapter 66.--PUBLIC UTILITIES
Article 1.--POWERS OF STATE CORPORATION COMMISSION

      66-1,118.   Assignment or transfer of certificate of convenience andnecessity or certificate of public service; approval ofcommission; application; notice and hearing; findings.(a) A certificate of public convenience and necessity or a certificate ofpublic service issued under theprovisions of the motor carrier act or any portion of the authorityconferred thereby may not be assigned or transferred without theconsent of the commission.

      (b)   Applications for transfer of any certificateof public convenience and necessity or any portion of the authorityconferred thereby shall be filed jointly by the assignor and theassignee. The commission may issue thetransfer, as prayed for, or issue the transfer for the partialexercise only ofthe privilege sought, and may attach to the exercise of the rightsgranted such terms and conditions as in the commission's judgmentthe publicconvenience and necessity may require. Approval of the proposed transferapplication, either in whole or in part, shallbe givenonly upon a finding by the commission thatthe applicant is fit, willing and able to perform such service, exceptthat if the commission finds that evidence shows that the proposed serviceis inconsistent with the public convenience and necessity, the commissionshall not approve the transfer.

      (c)   Application for the transfer of any certificate of public serviceshall be filed jointly by the transferor and the transferee and shall besubject tothe same provisions as the original application for a certificate of publicservice.
