Chapter 66.--PUBLIC UTILITIES
Article 1.--POWERS OF STATE CORPORATION COMMISSION

      66-1,174.   Municipally owned or operated retailelectric suppliers subject to commission jurisdiction; when.Except as provided byK.S.A. 2009 Supp.66-104f, and amendments thereto, amunicipallyowned or operated retail electric supplier shall besubject to commission jurisdiction as a public utility, as defined inK.S.A. 66-104, and amendments thereto, with respect to all operations withinitscertified territory extending more than three miles beyond itscorporate limits. A municipal retail electricsupplier shall besubject to regulation by the commission in matters relating to the rightto serve in the territory within three miles of the corporate cityboundary, except that the commission shall have no jurisdictionconcerning such retail electric supplier within its corporate limits.
