Chapter 66.--PUBLIC UTILITIES
Article 1.--POWERS OF STATE CORPORATION COMMISSION

      66-1,184a.   Disposition of revenues from certainsales.(a) As used in this section:

      (1)   "Electric public utility" has the meaning provided by K.S.A. 66-101a, andamendments thereto.

      (2)   "Renewable attributes" meanstradeable renewable energy credits (with or without other features), tradeableemissions credits, emission offsets or other market instruments created orobtained by use of renewable energy resources or technologies.

      (3)   "Renewable resources or technologies" means wind, solar,photovoltaic,biomass, hydropower, geothermal, waste incineration and landfill gas resourcesor technologies located in Kansas.

      (b)   Upon application of an electric public utility, the state corporationcommissionmay authorizesuch utility to:

      (1)   Retain 65% of the utility's net revenues from wholesale off-system salesofelectricity generated from renewable resources or technologies or from sales ofrenewable attributes if suchelectricity or attributes are purchased bythe utility at not less than the average pricepaidby such utility forelectricity or renewable attributes purchased pursuant to contracts of five ormore years' duration;and

      (2)   retain 50% of the utility's net revenues from all other wholesaleoff-system sales of purchased electricity generated from renewable resources ortechnologies or from sales of purchased renewable attributes from renewableenergy procured or constructed principally to serve Kansas retail customers.
