Chapter 66.--PUBLIC UTILITIES
Article 1.--POWERS OF STATE CORPORATION COMMISSION

      66-1,206.   Same; commission orders and decisions.(a) If after investigation and hearing the rates or rules and regulations ofany natural gas public utility governed by this actare found unjust, unreasonable, unfair, unjustly discriminatory orunduly preferential, or in any way in violation of the provisions of thisact, or of any of the laws of the state of Kansas, thecommission shall have the power to establish, and to ordersubstituted therefor, such rates or rules and regulations as the commissiondetermines to be just, reasonable and necessary. If itis found that any regulation, practice or act, relating to anyservice performed or to be performed by such natural gas public utilityfor the public is in any respect unreasonable, unjust, unfair,unreasonably inefficient or insufficient, unjustly discriminatory or undulypreferential, or otherwise in violation of any of the provisions of thisact or of any of the laws of the state of Kansas, thecommission may substitutetherefor such other regulations, practice, service or act asit determines to be just, reasonable and necessary.For the purposes of determining just and reasonable rates, the commissionmay adopt a policy of disallowing a percentage, notto exceed 50%, of utility dues, donations and contributions to charitable,civic andsocial organizations and entities, in addition to disallowing specific dues,donations and contributions which are found unreasonable or inappropriate.

      (b)   All orders and decisions of the commission whereby anyrates, rules and regulations, practice or actsrelating to any service performed or to be performed by any natural gas publicutility for the public are altered, changed, modified or established shall bereduced to writing, and a copy thereof, duly certified, shall be served onthe natural gas public utility affected thereby.Such order and decision shall become operative and effective within30 days after such service. Such natural gas public utility,unless an action is commenced in a court of properjurisdiction to set aside the findings, orders and decisions ofthe commission, or to review and correct the same, shall carry theprovisions of such order into effect.
