Article 12.--MISCELLANEOUS PROVISIONS

      66-1220a.   Disclosure of trade secrets andconfidential information,when.(a) The state corporation commission shall not disclose to or allowinspection by anyone, including but not limited to parties to a regulatoryproceeding before the commission, any informationwhich is a trade secret under the uniform trade secrets act(K.S.A. 60-3320 et seq. and amendments thereto) orany confidentialcommercial information of a corporation, partnership or individualproprietorship regulated by the commission unless the commission finds thatdisclosure is warranted after consideration of the following factors:

      (1)   Whether disclosure will significantly aid the commission infulfilling its functions;

      (2)   the harm or benefit which disclosure will cause to the public interest;

      (3)   the harm which disclosure will cause to the corporation, partnershipor sole proprietorship; and

      (4)   alternatives to disclosure that will serve the public interest andprotect the corporation, partnership or sole proprietorship.

      (b)   If the state corporation commission finds that disclosure iswarranted pursuant to subsection (a), the commission shall give thecorporation, partnership or individual proprietorship notice beforedisclosing the trade secret or confidential commercial information.
