Chapter 66.--PUBLIC UTILITIES Article 12.--MISCELLANEOUS PROVISIONS

66-1242. Same; recovery of capital expenditures fortransmission facilities.Upon application, the commission shall provide for recoveryof capitalexpenditures for construction or upgrade of any electric transmission line orappurtenances over aperiod of 15 years, unless: (a) The commission determines there is good causeto deny theapplication; or (b) recovery of capital expenditures for construction orupgrade of thetransmission line or appurtenances is already provided for by tariffs and ratesapproved by thefederal energy regulatory commission or its successors.
