Chapter 66.--PUBLIC UTILITIES
Article 12.--MISCELLANEOUS PROVISIONS

      66-1249.   Broadband deployment reporting program;definitions.As used inK.S.A. 2009 Supp.66-1249 through 66-1253, and amendments thereto:

      (a)   "Broadband" means any synchronous or asynchronous transmissiontechnology capable of speeds ofat least 200 kilobits per second in both directions to and from customer andprovider.

      (b)   "Census tract" means a tract identified on the most recent officialUnited Statesdecennial census maps.

      (c)   "Commission" means the state corporation commission.

      (d)   "Government" means the state and any department, agency, authority,institution or instrumentality thereof, any county, township, city, schooldistrict or other political or taxing subdivision of the state and any othernot-for-profit entity primarily funded by appropriations from tax revenues.

      (e)   "Potential broadband customer" means any residential, commercial orgovernment customer that could receive broadband service through existingtelephone or cable lines and has subscribed to such service, has elected not tosubscribe to such service or cannot subscribe to such service because suchservice is not provided.

      (f)   "Provider" means a provider of wireless, wireline, cable-modem and othertechnological meansof providinghigh speed internet accessservice to persons who are domiciled in Kansas.

      (g)   "Underserved rural areas" means that no more than 15% of potentialbroadband customers in a census tract are capable of receiving broadband of atleast 386kilobits per second in both directionsin accordance with the provisions ofK.S.A. 2009 Supp.66-1250 through 66-1253,andamendments thereto.
