Chapter 66.--PUBLIC UTILITIES
Article 12.--MISCELLANEOUS PROVISIONS

      66-1251.   Same; contents of report to legislature;confidentiality; rules and regulations; failure to comply with reportingrequirements.(a) On or before January 15, 2009, and annually thereafter,subject to the provisions ofK.S.A. 2009 Supp.66-1252, and amendments thereto,thecommission shallreport to the legislature on broadband service being provided in the state ofKansas. Such reportshall include the following information:

      (1)   A report by census tractorother identifiable geographic unit indicating whether broadband service isavailable and the number of providers that offer service to customers in eachcensus tract;

      (2)   beginning with the commission's report in 2010, a report by census tractof thechange in: (A) The number of broadband providers; and (B)the geographic area or census tract where broadband service is available.

      (b)   The commission shall maintain the information provided by each providerpursuanttoK.S.A. 2009 Supp.66-1250, and amendments thereto, as confidential and shallreport only theaggregated informationby census tract to the legislature. In maintaining the information, thecommission shall adhere to the confidentiality provisions in K.S.A. 66-1220a,and amendments thereto.

      (c)   The commission, after consulting with broadband providers, may adoptrules and regulations as necessary to establishthe formand manner in which the provider information shall be submitted and to fulfillall otherrequirements of the commission under this act.

      (d)   The commission shall, in addition to those reports required bysubsection (a), on or beforeJanuary 15, 2008, and annually thereafter, report to the legislature the namesof the broadbandservice providers that fail to comply with the reporting requirements ofK.S.A. 2009 Supp.66-1250, andamendments thereto.
