Article 12.--MISCELLANEOUS PROVISIONS

      66-1278.   Same; agents of commission; right ofingress and egress; restoration of premises.(a) In performing investigations or administrative functionsrelating to prevention of pollutionof the soil or waters of the state, the commission or the commission's dulyauthorized representativemay enter any property or facility which is subject to the provisions ofK.S.A. 2009 Supp. 66-1274, and amendmentsthereto, for the purpose of observing, monitoring, collecting samples,examining records andfacilities to determine compliance or noncompliance with state laws and rulesand regulationsrelating to air pollution, water pollution, soil pollution or public health orsafety.

      (b)   The representatives of the commission shall have the right ofingress and egress upon any landsto clean up pollution from the storage of compressed air over which thecommission has jurisdictionpursuant to K.S.A. 2009 Supp. 66-1274, and amendments thereto. Suchrepresentatives shallhavethe power to occupysuch land if necessary to investigate and clean up such pollution or toinvestigate and plug any suchcompressed air energy storage well. Any representative entering upon any landto investigate andclean up such pollution or to investigate and plug any such compressed airenergy storage well shallnot be liable for any damages necessarily resulting therefrom, except damagesto growing crops,livestock or improvements on the land. Upon completion of activities on suchland, suchrepresentative shall restore the premises to the original contour and conditionas nearly aspracticable.
